UEFA and FIFA have been accused of abuse of a dominant position in the dispute over the European Super League, a project that has so far been aborted. In its decision, the Madrid commercial court emphasizes that the two authorities have granted themselves the discretionary power to prohibit the participation of clubs in alternative competitions, details the Spanish prosecutor’s office in a document consulted by AFP.

This decision confirms the judgment of the Court of Justice of the European Union (CJEU) rendered in 2023. The CJEU then ruled that UEFA and FIFA rules on the prior authorization of club competitions violate European law, and that the ban on clubs and players was illegal.

Real Madrid claim “damages”

Real Madrid, one of the main instigators of the Super League project, reacted quickly. In a press release, the club welcomes the fact that the Madrid Court of Appeal has rejected the appeals filed by UEFA, the RFEF and La Liga, confirming that UEFA had
“seriously infringes the free competition rules of the European Union” and abused its dominant position.

The Madrid club goes even further, believing that this decision opens the way to reparations for the significant damage suffered since the announcement of the project, both financially, sportingly and in the media. For the moment, the other promoters of the Super League have not reacted, and the future of the competition remains uncertain.
