Mbappé, open investigation: prison, fines, image … everything is on the table

The 180,300 euros in checks signed to police officers set fire to the powder. Since mid-July, the Paris prosecutor's office has opened an investigation for hidden work and money laundering of tax fraud, after a tracfin report. The case is entrusted to the National Division of IGPN surveys. At the center of suspicions: unconcluded payments to five police officers (CRS) and three private security agents. In law, these practices could constitute hidden work and money laundering from tax fraud.

Sentence that is cold in the back

The Labor Code is not kidding with these offenses. According to articles L8221-1 and following, using without declaration or remuneration excluding pay sheet exposes to three years in prison and 45,000 euros fine. In the event of an organized band, the maximum sentence climbs to ten years and 100,000 euros. If the money laundering is retained, Mbappé risks an additional fine of up to 750,000 euros. Not to mention complementary sentences: prohibition to exercise, confiscation or publication of the judgment.

Several similar files allow these figures to be tempered. Sometimes these surveys do not even lead: for lack of sufficient evidence, they are classified without follow -up. Other cases, such as that of a Ligue 1 club in 2018 for unsuccessful security agents, ended with fines and contributions of contributions, without heavy sentences. The player claims to have acted “without consideration”, evoking a charity gesture. No private service should be attached to these payments. The investigation will now tackle the payments, question the agents concerned and meet the accounts. If no fraudulent intention is established, the prosecution could classify the case without follow -up. Conversely, an indictment, followed by a trial, could take place within 12 to 18 months.

The impact beyond the field

Apart from the judicial component, the case could tarnish the image of the captain of the Blues. Nike, Dior or EA Sports could be annoyed by a possible trial, even if no sponsor has broken his contract for the moment. The FFF or Real Madrid can not sanction anything as long as no guilt is established. But in the event of a conviction, even without incarceration, the impact would be considerable. For Mbappé, justice remains the most unpredictable opponent of his career.
